Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us and we want to communicate with you only if you want to hear from us. Even where you have consented to our processing of your personal information, you may withdraw that consent at any time by contacting legal@ludela.com. Please note that even if you withdraw, we may still collect and use non-personal information regarding your activities for non-interest based advertising purposes as otherwise described herein. 

We have additionally created mechanisms to provide you with the following control over your information: 

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Promotional Offers from Ludela or Third Parties. If you no longer wish to have your contact information used by Ludela to promote our own or third parties' products or services, you can opt out by either checking the relevant box located on the form on which we collect your data (the order/registration form), or by checking the "unsubscribe" link in our promotional emails. 
  • Rights of Access, Rectification, Erasure, and Restriction. Where permitted by applicable law, you may inquire as to whether we are processing personal information about you, request access to personal information, and ask that we correct, amend or delete your personal information where it is inaccurate or has been processed in violation of your rights under data privacy laws that apply in the country where you live. Where otherwise permitted by applicable law, you may send an email to legal@ludela.com or use any of the methods set out in this privacy policy to request access to, receive, seek rectification, or request erasure of personal information held about you by us. Such requests will be processed in accordance with local laws. 

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Accessing and Correcting Your Information

You can review and change your personal information by logging into the Services and visiting your account profile page.

You may also send us an email at legal@ludela.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Pursuant to California’s “Shine the Light” law, California residents who share personal information with us have the right to request and obtain from us once per year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties. Proper access and use of information provided on the Services is governed by our Terms of Use

Payment Processors

When you make purchases through the Services, we process your payments via a third-party payment processor. In these instances, the third party application may collect certain financial information from you to process a payment on behalf of Ludela, including your name, email address, address and other billing information in which case the use and storage of your financial information is governed by the third party terms, conditions and privacy policies. The use of that information by the financing partner will be subject to the financing partner’s terms, conditions and privacy policies. Our treatment of any financial information that we may process on your behalf, or that we receive from our financing partners or payment processors, is subject to this privacy policy. 

International Data Transfers

You agree that all personal information collected via or by Ludela may be transferred, processed and stored anywhere in the world, including but not limited to, the United States, in the cloud, on our servers, on the servers of our affiliates or on the servers of our service providers. By providing information to us, you explicitly consent to the storage of your personal information in these locations. 

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. 

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

Children Under the Age of 13

Our Services are not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Services.
